Can we sold a part of the house?
My three sisters and I inherited a house from my late father who stipulated in his will that it should be used as a holiday home. One of my sisters urgently needs money and as a result wants to sell her share of the house. If we refuse to buy from her, can she sell to a third party and how, since four of us are co-owners of the property?
“Wills” try to anticipate situations like this and their remedies and restrictions. So all will depend on the interpretation of what “the will” says. A lawyer who deals with deceased estates can assist. However if there is no restriction on sale, then either the three of you will have to settle with her or the property will have to be sold as a whole ( liquidated ) to enable her receive her portion. Unless it is subdivided with separate title deeds she cannot sell any portion to a third party.
