How do I defend my domain name?
Lawyers of a European company have been harassing me with respect to a company and domain name I legally registered in South Africa. They want a name change because they claim to have registered the trademark in several countries. How do I defend myself?
Did they say they had registered their name and trademark in South Africa? If not then they are blowing hot air. Trademarks must be registered in every territory you want to trade. Otherwise for them to succeed in forcing you to change your name, they will have to prove in a court of law that you are trying to trade off their name and trademark. In effect you are “passing off” your products as those of their company to confuse consumers that they come from their “ more reputable” brand.
