Dismissed for Theft – CCMA case … what is settlement
My Employee was dismissed due to theft after a polygraph test proved so. Now they have opened CCMA case for unfair dismissal. What would fair payment be to this employee. She worked for 8 years. Severance is only for retrenchment not dismissal. So if negotiations are successful what payment would be required.
Good Morning Noeline C, firstly let me state that dismissal in respect of theft is usually an acceptable proven standard of fair practice and most employees are aware of this. In respect of your question as to the severance or payment required if the employee is successful it will not be possible to estimate. It may also not be the only recompense asked for.
