Do I owe my deceased wifes creditors?
My wife and I was married for less than 6 months before she died, when we registered for marriage it was out of communal property but we never had a contract drawn up because we couldnt afford a lawyer. A law firm called Hack,Stupel & Gross sent me a summons for her ambulance fee and called me saying I could be arrested, in a panic I signed a contract with them to pay it off monthly and it also includes their service fee that is thrice that of the ambulance fee (she was taken to the state hospital Steve Biko because we didn’t have medical aid). What can I do?
Thank you. Every marriage is presumed to be entered into in community of property until otherwise proven through the registration of a valid ANC- AnteNuptial Contract. To answer your question, you will unfortunately be liable for the debts as no antenuptial contract was registered.
