Dismissed at work without my month salary
I was recently dismissed at work because of some money R5400 that I took.My boss didn’t pay my month’s salary that I work for and he claimed his taking back the money i took from.he opened a case against me.Does he have the right to take my pay and not pay me for that month

Your question is received, thank you. You see, in a business, stealing by an employee can have a huge negative effect on productivity and more worse if it is a small business. However, to address your question appropriately, may I ask whether you were also dismissed following the theft incident? If yes, was there a disciplinary inquiry? And, were you arrested after your employer opened the criminal case?

My answer to your question “Does he(employer) have the right to take my month’s pay towards the money I took?”, is that NO, he has no such right. However, he can if you give him consent in writing do so, or there is a court order empowering him to do so. The CCMA has jurisdiction in this regard and you should approach the Commission. Thank you.
