Car given as a gift.
My boyfriend bought me a car and give it to me as a surprise present and it was also a post on face book. We break up now he dont want to give the car back to me. Will i win if I go yo court? Is there case reports on matters like this. The car was bought and paid in cash by him.

Thank you for your assistance.Before I contacted you I already went to see a Lawyer and he issued Summons against my ex-boyfriend (seeing that there is an amount of money he also promised to give to me, I have this proof on messages he sent to me).Will we be successful with the Summons,or should we have taken the spoliation way?Will it be possible for me to come and see you and have you done matters like these before and succeeded in it?I really need your help please.
If you have proof that the car was given to you as a gift, then it is legally yours. He may dispute that it was a gift. If he transferred it into your name then you have a much stronger claim. You can get a lawyer to apply to court for a spoliation order ( ie to return your property ). It will then be up to him to dispute that the car was not a gift , and consequently not your property.
