A 3 month probation contract was signed between employer & employee. After a dispute over AA rates that was not paid for own vechile use as stated in contract it led to a immediate resignation. Is the employer entitled to hold employee liable for breakages out of employees control that had happenend during the time of employment. Is the client for who work was done allowed to hold employee accountable for breakages or is it the companies liablitie?
Hello. Breakages out of employees control? The answer is no. Can the client hold the employee accountable ..? No.The employee works within the course and scope of his employment, so the client should address it with the employer. I suggest you take your case to the CCMA.
