Process of Sueing a Person – Where do One Start , Who in Cape Town can Assist
A friend approached me with a business deal of flipping goods and needed a R20 000 which he would return within a week with R10 000 interest. Now a few weeks later all I’ve received in return is a bunch of excuses of which the latest is making a loan African bank to repay me. This loan is also dragging along and being postponed from one day to the other. I’ve been to my local police station to ask if I can lay a charge but they told me it’s a civil matter. With very little knowledge of the justice system I’m not sure at all where to turn to or how to get started. Would appreciate if you could guide me in the right direction. Thank You

Dear Mario P, the police are quite correct it is a civil matter. I suggest you go to your local magistrates court and speak to the clerk of the small claims court in respect of issuing a summons to recover your money. The clerk will assist you in this regard at no monetary cost.
