Change and approve of structure without consultation
I’m currently working in company that comprises of Senior engineer, engineer and technicians as well as operators/general workers. The duties of Senior engineer, engineer and technicians involves project management, compiling reports and supervising operators during the testwork. All the engineers and technical have being doing the same work for more five years and report direct to the head as per our contract.
Recently our head introduced a new finalized structure that requires the Engineers and technicians to report to the senior engineers. The structure was changed and approved without consultation. Please advise if this is right in terms of unilateral changes contained in the labour law.
Dear Molefe N, unilateral changes in respect of terms and conditions of employment can be disputed however a simple “shift change” is not a change in terms and conditions of employment. Put simply, if your ranking as employee has been degraded and salary decreased then that would be an unacceptable unilateral change.
