Rentrenchment and replacement
Can you be retrenched and replaced – with a new job spec. The job spec has changed and I’ve been asked to apply for the new role. However advised should I not get it (within one week of initial consult) I will be retrenched.
Hello. A company can retrench for operational reasons. But it should be done in consultation with the enployee and explained. As they have done, you should be given an opportunity to work in another capacity if that job opening is available. This requires a change in job specs and an adaptation of skills. So the answer unfortunately is yes. If you are not suitable for the new job opening they may retrench. However they have a duty to retrain you for the new role. If you suspect they are merely trying to get rid of you, approach your union or the CCMA.
