What is the legal requirement to settle a deceased estate?
My father-in-law was a state pensioner residing at MOTH Retirement Village. He had no assets at the time of his death apart from approx. R1 600.00 in a Nedbank account. He had a will drawn up many years ago when he was much younger and owned property. My mother-in-law was the beneficiary of his will. Unfortunately owing to many years of ill health he was forced to sell off all his assets. My mother-in-law is a state pensioner and she is still resident at the MOTH retirement village. Please advise me what is the legal requirements to settle this matter. Thank you very much.
Dear Alan B, I suggest to be on the safe side you contact the Master of the High Court Pieter marital urgent or Durban and just check with them. It seems it is unnecessary to register the estate as no dues will be due but it is best to check. Also your mother-in-law will be entitled to the money in the bank account as per your father’s will.
