Visitation rights denied by ex
I pay my child support every month. For the last 4 years I have been denied my rights to see my child or speak to her over the phone. My ex wife has blocked my numbers. I do not even know where my child lives. What is my options?
The Constitution of South Africa, section 28, provides that the best interest of the child is paramount in all decisions concerning the child. Your Ex’s decision to deny you visitation right without reason, taking your daughter to a destination unknown to you without your consent, blocking you from speaking to her on the telephone, are definitely not in the best interest of your child. Those are your legal rights which your Ex are blatantly and unjustifiably infringing upon.
Assuming you are sure of the area where she took your daughter to, my advise would be that you approach the children’s court (same as family court) in the Magistrate’s court in that area. Lodge your complaint through the clerk of the court. I have no doubt you will receive the needed assistance. Thank you.
