Rental increase with a lease
I have been renting on this property for 12 years now an there was no lease i used to pay R1300 an now all off a sudden the owner brings us a lease with a new rental of R2650 starting in 1 january 2018. Is this legal can he just up the rent so much and i cannot afford it. The owner of the property died 4 year ago an his son took over the property after the owner past on. An the property is in a bad state they want us to repair things that due to the age of the property deteroriorated. I feel this is unfair.
Evening Jade D, there is rent control and I suggest you take it up with the Rent Board/Burroughs. ..to answer your question yes the new owner may increase the rent and bring a lease contract (that is actually recommended) however he cannot expect you to repair damages due to age deterioration as you stated and expect you to pay a high amount for a property in a “bad” state. There are a few alternative solutions. If you need to do repairs then you need to negotiate a lower rent that will cover these costs or alternatively (if you paid a deposit 12 years ago) collect your deposit and ask the Burroughs /Municipality to assist you with their “low rent housing” they make available to persons with lower incomes.
