I was sujected to a breatherliser a month ago and failed. N
I sighned a final warning
I have passed every test since and now without nitice have be en striped of my duties monrh later is that leagle to do

Dear Aubrey R, my advice is that a diligent manager would not receive a final warning as they need to be an example to fellow employees do you not agree? so punishment has not been visited twice to the same crime I would submit it is the first punishment and quite legitimate. Congratulations on being clean since the final warning and continue in this regard to re-establish your good standing.

Aubrey the final notice was like a gift called “get out of jail free card” however the demotion may be in your contract of employment and nothing stops you from enquiring from the HR why you were not given the warning etc however they may have informed you during the final notice and you may have forgotten as alcohol can be quite devastating and you may have forgotten about it. The positive side is you have been clean or a good period now and you should continue on that basis to re-instate your position

Good Afternoon Aubrey, unfortunately the position remains the same if they asked you to stand in then it was a temporary appointment and you were happy to continue on that basis…management is supposed to be diligent and a good example to follow….
