Judgement on old debt
Hi, I took out a loan in 2012 and lost my job not long after. Since then I havnt made payments or had any contact with the bank (even tho my number never changed, they just never called). I then believed that the debt was written of and left it at that. Now years later a group of attorneys have placed a judgement on my name for that loan. Can this be done ?
No judgement can be placed on your name without a court process. This means a summons should have been served on you, you failed to respond, and the attorneys went to court to obtain a “ default judgement”. Go to the Attorneys and find out the case number, and the court. You can can go to the Clerk of the civil court and get a copy of the file to see what happened. You can then apply through an attorney to get the judgement rescinded ( set aside) if you have “just cause”. Alternatively you can arrange with the Creditor’s Attorneys to pay off the judgement debt on condition that they will give you a letter agreeing to a rescission ( setting aside ) of the judgement.
