My Bos Refuses To Speak To Me At All Weather It Be Telephonically , Via E-Mail Or In Person , She Is The owner Of The Business And There Are Only Two Other Employees , We Need To Communicate With Her As She Needs To Approve Quotes , Orders Etc . This Is Making it Increasingly Difficult To Do My Job ….. Is There Anything I Can Do ?
Section 186(1)(e) if the Labour Relations Act, states that an employee can terminate his or her employment with or without notice if the employer made continued employment intolerable.What this means is that the behaviour of your boss could be a constructive dismissal in terms of the Act of which you are entitled to resign and approach the bargaining council (if any) or the CCMA. However, our court has heard that employees should see resignation as a last resort, meaning that the employee must have done all that is within his (her) power to remedy the intolerable condition posed by the employer. What you can do is to record proof of your effort to address the situation. It will serve as evidence should you end up at the CCMA for instance.
