Contesting the sale of my family home
my mother will be selling the house to my sister i only found out once my mother moved out the house, they threaten to evict me once the house is in my sister’s name,
i also found out that the house is not in my mother’s name.
what is my next step ?
Unless an alternative accommodation is provided for you, neither your sister nor mother has the right evict you without a judicial ovetsight. Section 26(3) of the Constitution is very clear on this. The house is your mother’s and it is within her right to dispose it as she freely feels. You cannot challenge her right to sell the housr but you can challenge the eviction.
