Contract Cleaner got pricked by used needle in Private Clinic.
I’m the owner of a Cleaning Company. One of my cleaning ladies was pricked by a used needle while collecting used linen from the operating room. The the needle was amongst the linen instead of being exposed in the Hazardoes Medical waste container. Who will be responsible and liable for any cost arising from this incident

You can institute delictual damage action against the clinic for failing(omission) to dispose operating needle in the required manner hence the injury to your staff. Bear in mind that the legal process is shrouded with pitfalls and can be financially draining…litigation costs can be extremely high. So, you must be sure of your case especially be able to prove “causation” which is that either the doctor or nurse or any of the clinic’s personnel acted negligently by failing to dispose the needle.
