Transfer to Incorrect bank account number
I made a transfer to an incorrect bank account not the bank tells me that the other person has spent the money so can not do a reversal. I have tried contacting the person but she is ignoring my calls.
what options do I have ?
Unjustified enrichment is where one person receives a benefit or value from another at the expense of the latter without any legal cause for such receipt or retention of the value or benefit by the former. It is a form of theft. The Payment Association of South Africa [ PASA] hold the view that the paying customer has to be assisted by the bank where possible to effect such recovery of the funds. Though she may have used the funds but the bank should, in terms of PASA, should assist in other ways including furnishing her details to enable you pursue legal action via the courts.
