Where do my husband and i have to go to get temporary guardianship documents and is it free?
My dad wants to put my 6 year old son on his medical aid and can’t afford to put me on with my son so my husband and i agreed to give my dad temporary guardianship.
In terms of the Children’s Act 38 of 2005, an application for the assignment of guardianship of a minor to non natural parent(s) has to be brought at the High Court by any person who has the interest and wellbeing of the child. The court, before granting the order will take certain factors into consideration including but not limited to the best interests of the child, the relationship between the person and the child, etc.
Your father can approach the High Court in the area where he resides and launch the application for the guardianship of your child. On the other hand, a lawyer can be instructed in respect. Thank you.
