Much of the terms of the contract have not been adhered
My brother works on contract with a foreign company in Burundi. He is South African. He has not been paid for 6 months and much of the terms of the contract have not been adhered to. It is a Belgian company and all he gets are promises of money being transferred so that he will be paid. A lot is not going right. What can he do?
If the company has an office in South Africa and assets, he could launch a claim with the CCMA. But as it stands he is in a precarious position since he will probably not have the means to launch a claim in Belgium or Burundi. If he wants to cut ties with the company he should perhaps approach the Belgian embassy and/ or South African embassy in Burundi for assistance. Otherwise he will have to cut his losses.
