Summons was issued against me with incorrect amount.
Summons was issued against me for outstanding levies for a sectional title property. However the amount was incorrect as I had already made payments before the date of the summons. The summons states 11,500 rand , however due to the payments the outstanding balance should actually be 3,700 rand. Am I right to say that the summons is therefore invalid and therefore I am not liable?
Unfortunately the summons remain valid and you remain liable for the outstanding balance. All you can do is to go to court to prove that you have made payments. But this is unnecessary and can be resolved by a phone call to the body corporate or their attorneys without incurring legal cost. I will suggest you call the attorneys and arrange to pay the balance so that they can withdraw the summons.
