What my husband can get after divorce?
My marriage finally hit the rocks after 13 years. Things started going downhill the last 5 years, and we tried very hard to make it work. It got worse when two years ago I started an affair with a guy for whom I now have great feelings .My husband and his family have threatened to sue him for loss of affection etc. We were married with an ante-nuptial contract (ANC), and we do not have much property between us. I have said he can keep the household items etc, while we both drive away with the cars we own. We have no children.

South African law recognizes that no two people can be forced to stay together, and adultery is no longer grounds to punish the other party during divorce proceedings. It is a common reason in applications for a divorce decree. The major issues that usually remain to be resolved are often division of the estate and custody of children; and sometimes maintenance matters. In your case it seems there are few issues in contention. Your husband will be wasting his time and money in his law suit such are not winnable. If he manges to convince the court the compensation will be minuscule. It will only the lawyers who will come out winners. You should be able to get assistance with a simple divorce and a settlement agreement that can be made an order of court. If he does not agree, go ahead anyway. You can approach the clerk of a divorce court, at the magistrates court in your area or try these websites for a cost effective straightforward divorces.
