My ex-husband has stopped paying maintenance
My four year old marriage collapsed after my husband accused me of being a lesbian. All attempts to reconcile has failed. We reached an amicable settlement whereby he pays the bond of the house and continues to live there while I moved out to rent another place. The kid stays with me but he has stopped paying maintenance. My lawyer has taken R6000.00 from me for divorce proceedings but will do nothing until I cough up more money. He only issued summons and that is all. I have had to take on a roommate to help with rent and food in order to provide a suitable home for my daughter. Please help.
When couples have irreconcilable differences and can’t stay together, a formal decree of divorce is often the way out. The big issues are what to do with the property, according to how you were married, and children if any. Informal agreements have no force and effect. All that should be resolved during the divorce proceedings including maintenance and arrear maintenance for the child. Before divorce, a state family advocate can assist with issues of the child and maintenance. A settlement agreement will have force if both of you agree that it is made an order of court. Ask the lawyer o tell you how much it will all cost if the divorce is unopposed, and if it is opposed. Then you can make a decision as to your eventual cost. Otherwise you can approach a magistrate’s court that has divorce court. The clerk of the divorce court will help you with documentation and the process to getting a divorce cheaply and resolution of the outstanding issues.
