What warranties do property developers offer? In less than a year cracks have appeared in walls of a house I purchased from developers . Everything is falling apart. I suspect the material used was inferior. Is there not an automatic 5-year warranty for defects ? Do I have any claim from the builders? What can I do?

All new enrolled homes are provided with a “deemed warranty”, requiring the builder by law to rectify any workmanship related to defects that occur in the first 3 months after occupation. Rectify any roof leaks that occur in the first 12 months after occupation. Rectify any major structural defects that occur in the first 5 years after occupation. You should first notify the developer in writing of the problems and ask him how he plans to fix the problem according to law. You should also make him aware that his builder was required to be registered with the NHBRC (National Home builders Registration Council) Kindly request him to fix the problem. If he refuses or neglects to do so contact the NHBRC at 011- 317000 for assistance, and proceed to court if you get no joy. Get an attorney to sue for damages.
