Travelling with my son If we have no contact with Biological father 7years?
I am a South African citizen, my son (9) is British, we reside in Cape Town. We have no contact with his biological father in the UK,since my sons second birthday. Id like to travel with my son but the new law states that I need consent from my estranged. If we have not seen the man in almost a decade, how can we travel?
We are legally divorced and they have no contact with each other, What process would I have to follow to gain full custody or be able to travel with my son without his consent?
Any assistance on the matter would be appreciated…?

In June of 2015, the requirement that all minor children require the consent of their parents when traveling into or out of the Republic, was effected. This also apply to Minors who are of foreign nationals, like in your case. The consent of your son’s father as captured in his birth certificate is unfortunately required regardless of your marital status.
What you may do is to approach the court for an order granting full parental responsibilities and rights or full legal guardianship of your son exclusively to you.
