Exclusion from Shortlisting Unfair discrimination in Recruitment
HI I applied for a job I met the minimum requirements as an employee but was excluded from shortlisting as my past supervisor did not like me.One employee working there leaked minutes of shortlisting where minutes detail supervisors say I am not wanted because I had questioned labour unfairness in meetings in my last fixed term contract. This is also the reason they did not want to renew my contract as they renewed my colleagues contract. What do I do ? I have been waiting 3 months to get them to resolve my grievance.I was called for an interview, after I appealed but now appointments have been made and the supervisor says my outcome is not yet available from head office

- If your facts are correct then their actions may constitute an unfair labour practice. Discrimination based on the fact that you previously questioned their labour practices violates the employment equity act. I suggest you get a concrete answer about the outcome of your interview. If negative you may ask for reasons from your supervisor. Your next recourse will be to approach the CCMA armed with your facts. Here is a useful link on the Enployment Equity Act. http://www.labourguide.co.za/discipline-dismissal/731-workplace-discipline/623-take-note-discrimination-is-not-always-unfair
